Former Harps boss Patsy McGowan has High Court case against FAI and John Delaney dismissed

A case against the Football Association of Ireland and its CEO, John Delaney by former Finn Harps manager, Patsy McGowan has been dismissed.
Costs for the action, heard this morning in the High Court, were awarded to the FAI, by Mr Justice Nicholas Kearns.
Mr Justice Kearns, President of the High Court, heard legal argument from Mr Michael Conlon, Senior Counsel for Mr Delaney and the FAI and Mr Desmond Murphy, Senior Counsel for the plaintiff, Mr McGowan.
Mr Murphy told the court his client Patsy McGowan, Ballybofey, a pensioner, had been denied the opportunity to earn a living after the FAI and its CEO, John Delaney, took an alleged defamation case against the Donegal Democrat in 2008. An earlier alleged defmation case was taken by John Delaney’s father, Joe, and Michael Hyland, both FAI officers, against the Sunday People in 2006, the court was told.
Mr Murphy, referring to his client’s statement of claim, added that the actions of the FAI had brought huge emotional damage and distress to Mr McGowan as well as financial loss of earnings.
Mr Conlon, SC, moved a motion to have the case dismissed which was opposed.
Having considered the matter, Mr Justice Kearns granted the dismissal application. He ruled that a threat to initiate defamation proceedings on the face of it did not constitute and unlawful interference and he awarded costs to the FAI and Mr Delaney.
Afterwards Mr McGowan told reporters he was disappointed by the ruling.
It’s expected an appeal to the Supreme Court will be lodged by Mr McGowan.
