Cllr looks for council apology to family
Bundoran Town Councillor Florence Doherty (Ind) has called for the town council to send a letter of apology to a family for having wrongfully brought a prosecution for unauthorised development against them.
In March 2011, Judge Mary Devins told Ballyshannon District Court that she found the council’s prosecution case against siblings Patricia and Paul McCafferty of Rockingham House, Main Street, Bundoran, to be “fundamentally flawed”.
At Tuesday’s monthly council meeting, Cllr. Doherty proposed that a letter of apology be sent to the family of the late Maura McCafferty (their mother) on but the motion was not seconded.
Cllr. Eamon Barrett (FG) asked if the family had, in fact, been brought to court but did not receive an answer because the chairman, Cllr. Philip McGlynn (FF) proceeded to the next item on the agenda as the motion had not been seconded.
Cllr. Barrett said that, if it were true that the family had been wrongly prosecuted, he would “apologise personally” himself.
Cllr. Doherty insisted that his question be answered. “We took her to court wrongly and her family deserves an apology. Did we or did we not, Manager? Why will you not give a direct answer? We did wrong here. Can we not apologise for our mistakes?”
Speaking after the meeting, she said she was “awfully disappointed” that her colleagues had not supported the motion. “We have to own up to our mistakes. So, if they have been singled out for prosecution, I think they should be singled out for an apology.”
