Legal precedent in court



A Manorcunningham man who was twice the legal limit has made legal history after being cleared of drink driving at a sitting of Buncrana Court on Friday.

Lee Gibson, 24, from St Arnold Terrace in Manorcunningham was arrested in the Lidl carpark in Buncrana on September 13, last.

His solicitor, Frank Dorrian, fought the case on the grounds that his client’s rights were infringed when he was handcuffed by gardaí.

Garda Tom Duggan said Gibson returned a reading of 80mg/ml - the legal limit is 35. Under cross examination Garda Duggan said Gibson was handcuffed because he tried to run away.

Mr. Dorrian said that there was no record of that. Judge Paul Kelly dismissed the case.
