Hand stand allegation twin has case dismissed

An identical twin who was doing a handstand out of the sun-roof of a car had the charge dismissed against him at Letterkenny District court.

Shane Heaney, 21, with an address at Carrownagannagh, Milford was charged with getting into a moving vehicle at Black’s Glen, Ramelton on June 22, 2013, the weekend of the Donegal rally.

Sergeant Fergus McGroary described how he drove towards a car with someone who had their body coming out of the sun-roof coming towards him. He flashed the lights of the patrol car and the driver of the car, Peter Heaney pulled over.

During the hearing, solicitor Frank Dorrian argued that it was difficult to determine whether or not the defendant was trying to get into or out of the car.

The judge dismissed the charge.

The driver of the vehicle, Peter Heaney had his case adjourned to a court sitting on Monday.

Heaney, of the same address and same birth date is charged with dangerous driving during the same incident.
