Man committed stabbing because he was jealous

A man kicked down the door of an apartment and stabbed a man who was with his ex-girlfriend, a court has heard.

A man kicked down the door of an apartment and stabbed a man who was with his ex-girlfriend, a court has heard.

Ricardo Evangelista (26)of 33 Longsdale, Ballybofey pleaded guilty to assault causing harm to Maciej Drobot at Fort Apartments Letterkenny on November 3 2009.

He told gardaí that he committed the offence in a fit of jealousy because his ex-girlfriend was in the company of Mr Maciej and another friend.

Letterkenny Circuit Court heard that Evangelista kicked in the door of the apartment and stabbed Mr Drobot on the hand and shoulder with a construction knife.

Garda Thomas Franics Reagan told the court the woman told gardaí she had received calls that day from Evangelista and that later she went to the Grill nightclub. She said she felt Evangelista was watching the apartment. Two male friends accompanied her home and the defendant came to the apartment and broke down the door. The two men prevented him from entering and forced him away. He returned with a construction knife and stabbed Mr Drobot who needed surgery to his hand and was in a cast for four weeks.

Evangelista came to Ireland in 2007 and works as a mechanic and in farming. He admitted causing criminal damage to the door of the apartment and assaulting Mr Maciej. Fiona Crawford BL, instructed by Gallagher and Brennan Solicitors, said Evangelista was jealous. She said the Brazilian native has since had a child with the woman and that they have had a stormy relationship.

Judge John O’Hagan said the use of force and the production of a weapon was the main aggravating factor. “Once you do that you have to take responsibility for the consequences of your actions,” he said.

The judge said Evangelista, who has no previous convictions, had admitted responsibility for the offence. He sentenced him to one year in prison which was to be substituted by 180 hours community service.
